Annex 1: Right of withdrawal

Annex to the Terms and conditions (Section 8). Applies to consumers within the meaning of Section 13 of the German Civil Code (BGB) in distance contracts for use of the Splexit platform (paid accounts, modules, and comparable services).

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

Electronic withdrawal function (Section 356a BGB): You may also exercise your right of withdrawal online on the platform at app.splexit.de via the easily accessible withdrawal function available during the withdrawal period (“Withdraw contract” / “Withdrawal button”). If you use this online function, we will promptly send you confirmation of receipt on a durable medium (e.g. by email), including the content of the withdrawal declaration and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Special notes regarding the Splexit platform

No early expiry of the right of withdrawal. We do not use the option to have the right of withdrawal expire early when performance begins immediately (Section 356(4) BGB). Your right of withdrawal remains in full for fourteen days even if you use the platform during that period.

No compensation for value. We do not charge compensation for use of the platform up to the point of withdrawal (see Section 8(6) of the Terms and conditions).

Voluntary refund. In addition to the statutory right of withdrawal, we grant contracting parties who concluded their contract as private individuals an unconditional refund within fourteen days of conclusion of the contract. Details are set out in Sections 8(4) and 8(5) of the Terms and conditions.

Distribution via third parties. If the service was obtained via a distribution partner or third-party platform (e.g. an app store), different withdrawal and refund rules may apply (Sections 7(5) and 8(7) of the Terms and conditions). The contracting party is the seller indicated on the order or invoice.
